We make reasonable efforts to ensure that the Services are available and operate correctly at all times, but we do not guarantee uninterrupted or error-free access, and temporary interruptions or technical issues may occur. You are responsible for ensuring that your computer, mobile device, internet connection, and software meet the necessary requirements to access and use the Services, and we are not liable for any incompatibility or reduced functionality resulting from your equipment or connection.

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by gross negligence, fraud, or any other liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so some of the above limitations may not apply to you. In such cases, our liability shall be limited to the fullest extent permitted by the laws of your jurisdiction. You hereby consent to the personal jurisdiction and venue of such courts, and waive any objection on the basis of inconvenient forum or lack of jurisdiction, to the extent such waiver is legally permissible. Notwithstanding the foregoing, Winum reserves the right to initiate legal proceedings against you in any competent court, including in your country of residence, where necessary to protect our rights, enforce judgments, or pursue remedies in connection with fraud, intellectual property infringement, or other serious violations. You acknowledge that the choice of governing law does not affect your rights as a consumer under any mandatory provisions of the laws of your country of residence, where such provisions apply and cannot be derogated from by agreement.
