During any investigation, you agree to cooperate fully with our requests for information, documentation, or clarification, to the extent legally permitted. Our determination regarding your involvement in prohibited activities will be based on the totality of evidence available, and, subject to your rights under the Complaints & Dispute Resolution section, shall generally be final.

Limitation of Liability

We make reasonable efforts to ensure that the Services are available and operate correctly at all times, but we do not guarantee uninterrupted or error-free access, and temporary interruptions or technical issues may occur. You are responsible for ensuring that your computer, mobile device, internet connection, and software meet the necessary requirements to access and use the Services, and we are not liable for any incompatibility or reduced functionality resulting from your equipment or connection.
Nothing in these Terms shall exclude or limit liability for death or personal injury caused by gross negligence, fraud, or any other liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so some of the above limitations may not apply to you. In such cases, our liability shall be limited to the fullest extent permitted by the laws of your jurisdiction. Use of external dispute resolution does not preclude you from pursuing other legal remedies, but it may be a prerequisite or recommended step in some jurisdictions.
Any complaint or dispute must be raised within a reasonable period after the event giving rise to it, and in any case within the timeframe specified by applicable law or regulation, or it may be considered waived. We reserve the right to reject complaints that are frivolous, abusive, or clearly unfounded, as well as those based solely on dissatisfaction with gambling outcomes that fall within expected statistical variance. Communications relating to complaints shall be treated confidentially, subject to any obligations to report matters to authorities or regulatory bodies. Governing Law

Where no specific governing law is stated, the laws of the jurisdiction in which Winum is legally established and licensed to operate its Services shall apply, without giving effect to any principles of conflicts of law. You agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the courts or tribunals of competent jurisdiction in that governing law jurisdiction, unless applicable mandatory laws grant you the right to bring proceedings elsewhere.
You hereby consent to the personal jurisdiction and venue of such courts, and waive any objection on the basis of inconvenient forum or lack of jurisdiction, to the extent such waiver is legally permissible. Notwithstanding the foregoing, Winum reserves the right to initiate legal proceedings against you in any competent court, including in your country of residence, where necessary to protect our rights, enforce judgments, or pursue remedies in connection with fraud, intellectual property infringement, or other serious violations. You acknowledge that the choice of governing law does not affect your rights as a consumer under any mandatory provisions of the laws of your country of residence, where such provisions apply and cannot be derogated from by agreement.
If any provision of these Terms is inconsistent with a mandatory legal rule in the applicable jurisdiction, that rule shall prevail to the extent of the inconsistency, and the remaining provisions shall continue to be valid and enforceable. Final Provisions

We may assign, transfer, or delegate our rights and obligations under these Terms, in whole or in part, to any affiliated entity or successor in interest, as part of a corporate reorganization, merger, acquisition, or other transaction, without prior notice to you, provided that such assignment does not diminish your rights under applicable law. If you do not agree with any future changes to these Terms, you must immediately discontinue use of the Services and request closure of your account. Your continued use of the Services after changes are published constitutes your acceptance of the updated Terms. In case of any inconsistency between the English version and a translated version, the English version shall prevail as the authoritative text for interpretation and enforcement of the Terms associated with Winum.
